This Content & Wellness Disclaimer (“Disclaimer”) is a material part of your agreement with Heartbox LLC and your use of the Heartbox mobile application (“App”) and any related services we provide in connection with the App (collectively, the “Service”). Please read this Disclaimer carefully. It clarifies the nature of the Service, what the Service is and is not, and your responsibilities when using it. This Disclaimer is incorporated by reference into our Terms of Service and forms part of your binding agreement with us. By accessing or using the Service, you acknowledge that you have read, understood, and agree to this Disclaimer. If you do not agree, do not use the Service.

1. Scope and Application

This Disclaimer applies to all users of the Service, including visitors who have not created an account, and to all use of the Service. It applies to all content, features, and functionality offered through the App, including but not limited to: check-ins (mood, scale-based or custom responses); journal-style entries and reflection features; goals and progress tracking; health area surveys and quizzes; workout or activity tracking; any sessions, consultations, or interactions with consultants (“gurus”) or other users; and any other tools, content, or features we provide. This Disclaimer applies regardless of how you access the Service (e.g., mobile device, tablet, or any future platform).

2. Purpose of This Disclaimer

Heartbox is a journaling and wellness application designed to support self-reflection and general well-being. This Disclaimer makes clear that the Service is not therapy, medical advice, mental health treatment, or professional healthcare of any kind. We are not a healthcare provider, mental health provider, or crisis service. By using the Service, you acknowledge and accept these limitations and your own responsibility for your decisions, actions, and well-being. This Disclaimer is intended to protect both you and us by ensuring that the nature and limitations of the Service are clearly understood. Apple, Google, and other app reviewers expect this type of disclaimer for apps that touch on mental wellness or journaling; it is also important for liability protection.

3. Self-Reflection and General Wellness Only

3.1 Nature of the Service

The Service provides tools and features for self-reflection and general wellness only. These may include, without limitation: prompts and check-ins to help you reflect on your mood and well-being; journal-style or note-taking features; goal-setting and progress tracking; surveys or quizzes related to wellness or life areas; and optional features such as workouts, sessions with consultants, or social features. The Service is intended for personal reflection, awareness, and general wellness support only. It is not intended to:

  • Diagnose any medical or mental health condition

  • Treat, cure, or prevent any medical or mental health condition

  • Provide therapy, counseling, or clinical mental health treatment

  • Replace or substitute for professional medical, psychiatric, psychological, or therapeutic care

  • Provide any form of clinical assessment, treatment plan, or professional recommendation

3.2 Not a Substitute for Professional Care

The Service does not replace and is not a substitute for advice, diagnosis, or treatment from a qualified healthcare provider, mental health professional, therapist, counselor, or other licensed professional. If you have or suspect you have a medical or mental health condition, or if you have questions about your health or well-being, you should always seek the advice of your physician or other qualified health provider. Do not disregard professional medical or mental health advice or delay seeking it because of something you have read, viewed, or used in the Service. Nothing in the Service is intended to be or should be construed as professional medical, psychiatric, psychological, or therapeutic advice.

3.3 No Emergency or Crisis Support

The Service does not provide crisis support, emergency services, or real-time intervention. We do not monitor the Service for crisis or emergency situations. We are not a crisis hotline, emergency service, or suicide prevention service. If you are in crisis, have thoughts of self-harm or suicide, or believe you or someone else may be in danger, you must contact emergency services or a crisis helpline immediately. Do not rely on the App for emergency or crisis support.

You agree that you will not rely on the Service for emergency or crisis support and that you will seek appropriate emergency or crisis services when needed.

4. Your Responsibility for Your Decisions and Well-Being

4.1 You Are Responsible for Your Decisions and Actions

You are solely responsible for your own decisions, actions, and well-being. Content and features in the Service are provided for informational and self-reflection purposes only. We do not guarantee any particular health, wellness, emotional, or life outcome. You are solely responsible for any decisions or actions you take based on your use of the Service, including but not limited to decisions related to your health, mental health, relationships, or life choices. We are not liable for any such decisions or actions or for any consequences that result from them.

4.2 Emotional and Psychological Reliance

Journal entries, check-ins, and other content you create or view in the Service are for your personal reflection only. If you experience emotional distress, rely on the Service in a way that affects your well-being, or find that your use of the Service triggers or exacerbates difficult emotions, you are responsible for seeking appropriate professional support. We are not liable for any emotional or psychological reliance you place on the Service or its content, or for any distress, harm, or outcome that you attribute to your use of or reliance on the Service. The Service is not a substitute for professional mental health or emotional support.

4.3 Consult a Professional

Consult your doctor or a qualified professional before making any decisions that could affect your health, mental health, or well-being. This includes, but is not limited to: starting or stopping any treatment or medication; making significant life decisions based on content or reflections in the Service; or interpreting any information in the Service as applicable to your specific situation. We do not provide personalized medical, psychiatric, or therapeutic advice.

5. No Guarantee of Accuracy, Completeness, or Suitability

5.1 Content Provided “As Is”

All content, features, and information provided through the Service are provided “as is” and for general informational and self-reflection purposes only. We do not guarantee the accuracy, completeness, timeliness, or suitability of any information, feature, or content for your particular situation. Content may contain errors, omissions, or may be outdated. We do not warrant that any content or feature is appropriate for your specific needs or circumstances. You use the Service at your own risk.

5.2 User-Generated and Third-Party Content

Content created or shared by other users, consultants (“gurus”), or third parties (including in sessions, surveys, or social features) does not constitute professional medical, psychiatric, psychological, or therapeutic advice. We do not endorse, verify, or guarantee the accuracy, completeness, or appropriateness of such content. Such content is not a substitute for professional advice. Any views, suggestions, or information expressed by other users or consultants are their own and do not represent our views or recommendations unless we expressly state otherwise.

5.3 No Professional Relationship

Use of the Service, including any sessions or interactions with consultants or other users, does not create a doctor-patient, therapist-client, or other professional healthcare relationship between you and Heartbox LLC or between you and any consultant, unless a consultant is separately licensed and you have established such a relationship outside the Service in accordance with applicable law. We do not provide clinical or professional services through the App.

6. Consultants (“Gurus”) and Optional Features

If the Service offers optional sessions, consultations, or interactions with consultants (“gurus”) or other third parties: such sessions or interactions are for general wellness, coaching, or informational purposes only, unless we expressly state otherwise and unless the consultant is appropriately licensed and you have a separate professional relationship with them. We do not guarantee that any consultant is licensed to provide medical, mental health, or therapeutic services in your jurisdiction. Any advice or information provided by a consultant through the Service is not necessarily professional medical or mental health advice. You are responsible for verifying the qualifications of any third party you choose to interact with and for seeking licensed professional care when needed.

7. Limitation of Liability (Disclaimer Context)

To the extent permitted by applicable law, Heartbox LLC, its affiliates, and their respective officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, emotional distress, or other harm, arising out of or related to: (a) your use of or reliance on the Service for health, wellness, mental health, or emotional support; (b) any decision or action you take based on content or features in the Service; (c) any emotional or psychological reliance you place on the Service or its content; or (d) the absence or inadequacy of crisis, emergency, or professional care, where you relied on the Service instead of seeking such care. The limitations in our Terms of Service (including the limitation of liability and disclaimers) apply in full to your use of the Service in connection with health, wellness, and emotional support. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability will be limited to the maximum extent permitted by law.

8. Updates to This Disclaimer

We may update this Disclaimer from time to time. We will post the revised Disclaimer in the App and/or at our designated URL (e.g., [CONTENT_DISCLAIMER_URL]) and update the “Last updated” date at the top. Your continued use of the Service after the effective date of changes constitutes your acceptance of the revised Disclaimer. For material changes that affect the nature of the disclaimers set forth here, we may provide additional notice (e.g., in-app notification or email) where required by law or as a matter of good practice. If you do not agree to the revised Disclaimer, you must stop using the Service.

9. Incorporation into Terms of Service and Conflict

This Disclaimer is incorporated by reference into our Terms of Service. The non-medical disclaimer in Section 4 of the Terms of Service reflects the same principles and is a material term of your agreement with us. By using the Service, you agree to this Content & Wellness Disclaimer and to the Terms of Service. In the event of any conflict between this Disclaimer and the Terms of Service with respect to the nature of the Service, disclaimers of medical or therapeutic advice, or your responsibilities regarding health and wellness, this Disclaimer shall control with respect to that subject matter.

10. Severability

If any provision of this Disclaimer is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties’ intent, or, if modification is not possible, severed from this Disclaimer.
