This Acceptable Use Policy (“AUP”) sets forth the rules and standards that apply when you access or use the Heartbox mobile application (“App”) and any related services, websites, or content we provide in connection with the App (collectively, the “Service”). This AUP is part of and incorporated by reference into our Terms of Service. By accessing or using the Service, you agree to comply with this AUP. Violation of this AUP may result in removal of content, suspension or termination of your account, loss of access to the Service, and may expose you to legal action. We reserve the right to enforce this AUP in our sole discretion.

1. Scope and Definitions

1.1 Scope

This AUP applies to all users of the Service, including visitors who have not created an account, and to all use of the Service regardless of device or platform (e.g., iOS, Android, or any future platform). It applies to:

  • All content you submit, upload, post, transmit, or otherwise make available through the Service (“User Content”), including check-ins, journal entries, messages, profile information, and any other data or materials

  • All conduct in or through the Service, including your interactions with other users, with consultants (“gurus”), and with our personnel

  • All use of the App’s features, including but not limited to check-ins, goals, journal-style features, surveys, quizzes, guru or session features, social or friend features, games, and any communication or messaging features

  • Any use of our systems, networks, or infrastructure in connection with the Service

This AUP is incorporated by reference into our Terms of Service and is enforceable as part of your agreement with us. Capitalized terms used but not defined here have the meanings given in the Terms of Service or our Privacy Policy.

1.2 Updates

We may update this AUP from time to time. We will post the revised AUP in the App and/or at our designated URL (e.g., [AUP_URL]) and update the “Last updated” date at the top. Your continued use of the Service after the effective date of changes constitutes your acceptance of the revised AUP. For material changes, we may provide additional notice (e.g., in-app notification or email) where required by law or as a matter of good practice. If you do not agree to the revised AUP, you must stop using the Service.

2. Lawful Use Only

You agree to use the Service only for lawful purposes and in accordance with all applicable local, state, national, and international laws, regulations, and ordinances. You may not use the Service to:

  • Violate any applicable law or regulation, including but not limited to laws governing privacy, data protection, intellectual property, defamation, fraud, consumer protection, and export control

  • Infringe, misappropriate, or violate the intellectual property, privacy, publicity, or other rights of any third party

  • Transmit, store, or facilitate any illegal content or activity, or solicit or encourage others to do so

  • Violate or circumvent any applicable export control, sanctions, or embargo laws or regulations (e.g., of the United States or your country of residence)

  • Use the Service in any jurisdiction where such use would be illegal or would subject us or our service providers to regulatory or legal liability

You are solely responsible for ensuring that your use of the Service complies with all applicable laws. We may suspend or terminate your account and report conduct to authorities where we reasonably believe you have violated applicable law.

3. No Harassment, Abuse, or Harm

You may not use the Service to harass, abuse, bully, threaten, stalk, intimidate, or harm others, or to incite or encourage others to do so. Prohibited conduct includes, but is not limited to:

  • Harassing or abusive conduct toward other users, consultants (“gurus”), or our personnel, including repeated unwanted contact, insults, or demeaning language

  • Threatening or intimidating language or behavior, including threats of violence, harm, or retaliation

  • Hate speech or content that promotes or incites violence, hatred, or discrimination against individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or other protected characteristics

  • Sexual harassment or inappropriate sexual content directed at others without consent, including unsolicited sexual advances, explicit content directed at specific individuals, or content that sexualizes minors

  • Doxing or doxxing — sharing or publishing another person’s private or personally identifiable information (e.g., real name, address, phone number, email) without their consent with intent to harass, threaten, or harm

  • Coordinated inauthentic behavior — using multiple accounts or coordinating with others to harass, manipulate, or mislead other users or us

  • Encouraging or glorifying self-harm, suicide, or dangerous behavior in a way that we reasonably determine is harmful to others

We may remove User Content that violates this section, suspend or terminate your account, and report conduct to law enforcement or other authorities where appropriate. We take reports of harassment and abuse seriously and will investigate in accordance with our internal procedures.

4. No Illegal or Harmful Content

You may not use the Service to create, upload, post, transmit, or distribute User Content that:

  • Is illegal under applicable law

  • Promotes or facilitates illegal activity, including but not limited to drug trafficking, weapons trafficking, human trafficking, money laundering, or fraud

  • Constitutes fraud, phishing, or deception, including impersonation for financial gain or schemes designed to deceive others

  • Contains malware, viruses, Trojan horses, or other harmful code, or links to or promotes such content

  • Exploits or endangers minors in any way, including child sexual abuse material (CSAM) or content that sexualizes or targets minors; we will report such content to the National Center for Missing & Exploited Children (NCMEC) and law enforcement as required by law

  • Promotes terrorism or violent extremism, or supports designated terrorist organizations

  • Promotes or facilitates self-harm, suicide, or dangerous behavior in a way that we reasonably determine is harmful (e.g., graphic or instructional content that could encourage self-harm)

  • Constitutes counterfeit goods or services, or promotes the sale of counterfeit or pirated materials

  • Otherwise harms or could harm other users, the Service, or us, as we reasonably determine

We reserve the right to remove any User Content that violates this section, to suspend or terminate accounts that post or promote such content, and to report conduct to law enforcement or other authorities. We have zero tolerance for content that exploits or endangers minors and will take immediate action, including termination and reporting.

5. No Unauthorized Access or Interference

You may not:

  • Attempt to gain unauthorized access to the Service, our systems, networks, or servers, or to the accounts, data, or devices of other users

  • Circumvent or attempt to circumvent any security or access controls, authentication mechanisms, or technical limitations of the Service

  • Use another user’s account, credentials, or identity without their express consent

  • Use the Service in any way that could damage, disable, overburden, or impair the Service or our infrastructure, or interfere with any other party’s use or enjoyment of the Service

  • Introduce viruses, malware, or other harmful code into the Service or into the devices or systems of other users

  • Engage in denial-of-service attacks or similar activity designed to disrupt the availability or performance of the Service

  • Probe, scan, or test the vulnerability of the Service or our systems without our prior written authorization (except where authorized under a bona fide security research program we have established)

Violation of this section may result in immediate suspension or termination of your account and may expose you to civil and criminal liability. We will cooperate with law enforcement in the investigation and prosecution of unauthorized access and related offenses.

6. No Reverse Engineering or Automated Misuse

You may not:

  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App or any part of the Service, except to the extent that applicable law expressly permits such activity and such permission cannot be waived by contract

  • Scrape, crawl, spider, or use automated means (e.g., bots, scripts, scrapers, or other software or tools) to access the Service, collect data from the Service, or interact with the Service in any way, except for normal personal use of the App through a standard mobile or web client we provide, unless we expressly permit such activity in writing

  • Extract, harvest, or collect data from the Service (including user data or content) through automated or manual means for purposes other than your own personal use within the App, unless we expressly permit it

  • Use the Service to build a competing product or service, or to copy, replicate, or derive data, functionality, or design for any commercial purpose, without our prior written consent

  • Interfere with or disrupt the integrity or performance of the Service or the data contained therein

  • Attempt to gain unauthorized access to our systems, networks, or the systems or networks of our service providers

Violation of this section may result in immediate termination of your account, loss of access to the Service, and may expose you to legal action, including claims for damages and injunctive relief. We monitor for automated abuse and reserve the right to block or restrict access from sources we identify as engaging in such activity.

7. No Impersonation or Misrepresentation

You may not:

  • Impersonate any person or entity, including but not limited to another user, a consultant (“guru”), a Heartbox LLC employee or representative, or any public figure, or falsely state or imply an affiliation with any person or entity

  • Misrepresent your identity, qualifications, or affiliation with any person or entity

  • Create an account using a false identity, a fictitious name, or someone else’s identity or personal information without their express consent

  • Impersonate or misrepresent a brand, company, or organization

  • Use the Service to deceive others for any purpose, including financial gain or to obtain personal information

We may suspend or terminate accounts that impersonate others or that we reasonably believe are fake or inauthentic. We may also remove User Content that constitutes impersonation or misrepresentation.

8. No Misuse of Account or Features

You may not:

  • Share your account credentials (e.g., username, password) with others or allow any other person to access your account, except where we expressly allow it (e.g., family sharing or account management features we may offer)

  • Create or maintain multiple accounts for a single person in violation of our Terms of Service, or create accounts for the purpose of evading enforcement of this AUP or our Terms of Service

  • Use the Service to send spam or unsolicited messages, including bulk or automated messages, commercial solicitations, or communications that recipients have not requested

  • Use guru, social, or communication features to solicit, advertise, or promote unrelated commercial services, products, or opportunities in a way that we reasonably determine is abusive, disruptive, or inconsistent with the intended use of those features

  • Abuse reporting or support channels by submitting false reports, frivolous complaints, or repeated requests that consume resources without good faith

  • Resell, sublicense, or commercially exploit access to the Service or any part thereof without our prior written consent

  • Use the Service in any way that could impose an unreasonable or disproportionately large load on our infrastructure or that of our service providers

We reserve the right to limit or restrict features (e.g., messaging, friend requests) for accounts we reasonably believe are misusing the Service, and to suspend or terminate accounts that repeatedly or seriously violate this section.

9. Protection of Minors

The Service is not directed at children under 13. You may not use the Service to target, contact, or interact with minors in a manner that is inappropriate, harmful, or that violates applicable law (including laws governing the protection of minors online). You may not upload or share content that exploits or endangers minors. For more information, see our Child Safety & Age Restriction Policy. Violation of this section may result in immediate termination of your account and reporting to law enforcement and appropriate authorities.

10. Privacy and Data of Others

You may not use the Service to collect, store, or process the personal information or data of others without their consent and in compliance with applicable law. You may not use the Service to violate the privacy or data protection rights of any person. You are responsible for ensuring that any User Content you submit does not include the personal information of others without their consent (e.g., names, contact details, or other identifiable information) unless such inclusion is permitted by law and consistent with the context of the Service.

11. Enforcement

11.1 Our Rights

We reserve the right to:

  • Investigate any suspected violation of this AUP, including by reviewing User Content, account activity, and other information available to us or reported to us

  • Remove or disable access to any User Content that we reasonably believe violates this AUP, without prior notice to you

  • Suspend or terminate your account or your access to the Service, with or without notice, if we reasonably believe you have violated this AUP or engaged in conduct that is harmful to other users, the Service, or us

  • Report conduct to law enforcement, regulatory authorities, or other third parties (e.g., the National Center for Missing & Exploited Children) where we believe such reporting is required by law or appropriate under the circumstances

  • Take any other action we deem necessary or appropriate to protect the Service, our users, our personnel, or us, including legal action

11.2 Notice and Immediate Action

Where reasonable and practicable, we will give notice before taking action (e.g., warning, temporary suspension). We may act without prior notice where we reasonably believe immediate action is necessary, including but not limited to: (a) illegal content or activity; (b) content that exploits or endangers minors; (c) security threats or unauthorized access; (d) serious harassment, threats, or violence; (e) fraud or phishing; or (f) other circumstances where delay could cause harm.

11.3 Effect of Termination

If we suspend or terminate your account for violation of this AUP, your right to use the Service ceases immediately. We are not obligated to provide a refund for any paid period remaining at the time of termination where termination is due to your violation of this AUP or our Terms of Service. We may retain information related to your account and conduct as permitted by our Privacy Policy and applicable law (e.g., for legal compliance, dispute resolution, or enforcement).

11.4 No Waiver

Our failure to enforce this AUP in any instance does not waive our right to enforce it in any other instance or against any other user. We may enforce this AUP in our sole discretion, and we are not obligated to take any particular action in response to every violation or report.

12. Reporting Violations

If you become aware of conduct or User Content that you believe violates this AUP, please report it to us at acfrank@heartbox.life. Include a description of the conduct or content and, if applicable, the username or other identifier of the account involved and where the conduct or content appeared. We will review reports in accordance with our internal procedures. We may not disclose the outcome of our review or any action we take to the reporting party or others, except as required by law or as we deem appropriate.

13. Severability

If any provision of this AUP is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties’ intent, or, if modification is not possible, severed from this AUP.

14. Relationship to Terms of Service and Other Documents

This AUP is part of and incorporated into our Terms of Service. The Terms of Service contain additional provisions that apply to your use of the Service, including but not limited to: description of the Service, user accounts and eligibility, intellectual property, limitation of liability, indemnification, governing law, and dispute resolution. In the event of a conflict between this AUP and the Terms of Service with respect to acceptable use or enforcement, this AUP shall control with respect to that subject matter. Nothing in this AUP limits your right to delete your account (see our Data Deletion Policy) or our right to suspend or terminate your account under the Terms of Service for reasons other than AUP violations.
